2. About Happenster

Happenster (happenster.com) is an event discovery and syndication platform that aggregates event listings from multiple sources to help users find and attend events in their area. Happenster operates as an independent platform and is not affiliated with, endorsed by, or officially connected to Ticketmaster, Live Nation, or any of their subsidiaries or affiliated entities.

4. No Endorsement or Partnership

The display of Ticketmaster event listings on Happenster does not constitute an endorsement, partnership, sponsorship, or affiliation between Happenster and Ticketmaster. Event data, images, pricing, and availability shown on Happenster are sourced from publicly available APIs and may not reflect real-time accuracy. Happenster makes no warranties regarding the completeness, accuracy, or timeliness of any third-party event listing.

5. Happenster-Native Events

Events created directly on the Happenster platform by registered organizers ("Happenster Events") are subject to separate policies including our Refund Policy, Event Creator Agreement, and Ticket Purchase Terms. Happenster assumes responsibility only for transactions processed directly through the Happenster platform for Happenster-native events.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HAPPENSTER AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of revenue, profits, or data resulting from the use of, or inability to use, third-party event services.
• Any damages arising from reliance on third-party event information displayed on Happenster.
• Any damages resulting from transactions conducted on third-party platforms accessed through Happenster links.

Happenster's total cumulative liability to you for any claim arising from or relating to the Service shall not exceed the total fees, if any, paid by you directly to Happenster in the twelve (12) months preceding the claim.

7. Indemnification

You agree to indemnify, defend, and hold harmless Happenster and its affiliates, officers, agents, and employees from and against any claims, liabilities, damages, losses, and expenses — including reasonable legal and accounting fees — arising out of or in any way connected with your use of third-party platforms accessed via Happenster, your violation of these Terms, or your violation of any third-party rights including Ticketmaster's terms of service.

8. External Links & Third-Party Websites

Happenster may contain links to third-party websites, including but not limited to Ticketmaster.com. These links are provided solely for user convenience. Happenster has no control over the content, privacy policies, or practices of any third-party websites and expressly disclaims all responsibility for them. Accessing a third-party website through a Happenster link is done entirely at your own risk.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Utah, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Utah, and you hereby consent to personal jurisdiction and venue therein.

10. Dispute Resolution

Any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved within thirty (30) days, the parties agree to submit to binding arbitration in Utah in accordance with the American Arbitration Association's rules. You waive any right to participate in a class action lawsuit or class-wide arbitration against Happenster.

11. Changes to These Terms

Happenster reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting to the website. Your continued use of the Service after any modification constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
